Terms of Service
Last updated CONFIRM DATE
This page is a design shell, not new legal language. The redesign preserves your existing Terms word-for-word and gives them the same typography, header, and carrier identification as the rest of the site.
What this page should cover
- Acceptable use of the site and application forms
- That submitting an application creates no employment or contractual relationship
- That Benefits Representative is an independent contractor position, not employment
- SMS and communication terms, message frequency, and opt-out instructions
- Accuracy of information submitted by applicants
- Intellectual property and limitation of liability
- Governing law and how disputes are handled
- How the terms may change and how applicants are notified
One clause worth reviewing carefully
The site’s public-facing copy previously described the position with a salary range and a set Monday–Friday schedule while also describing representatives as independent contractors. Those two descriptions cannot both be operative.
The redesigned pages state consistently that the role is a 1099 independent-contractor, commission-only position with no set schedule. Your Terms should say the same thing, in the same words, so nothing on the site contradicts the contractor relationship.
Confirm Counsel should review the Terms against the redesigned copy and against the actual independent-contractor agreement representatives sign.
